In consideration for being permitted to participate in any clinic, camp, lesson, open gym, beach volleyball activity, performance training session, tournament-related activity, or other program offered by One Ohana Volleyball LLC or One Ohana LLC (collectively, “One Ohana”), the participant and, when the participant is under 18, the participant’s parent or legal guardian agree as follows:

1. Voluntary Participation and Assumption of Risk

Volleyball, athletic training, conditioning, and related activities involve inherent and other risks of injury. These risks include, without limitation, falls; collisions with people, balls, nets, poles, walls, floors, sand, equipment, or other objects; strains; sprains; fractures; concussions; illness; communicable disease; heat-related illness; weather-related hazards; property loss; permanent disability; and death.

I understand that risks may arise from my own actions or inaction, the actions or inaction of others, the condition of the premises or equipment, travel or transportation connected with a program, and the ordinary negligence of a Released Party. I voluntarily choose to participate and knowingly assume all risks, known and unknown, to the fullest extent permitted by Washington law.

2. Release and Waiver

To the fullest extent permitted by Washington law, I release and waive claims against One Ohana Volleyball LLC, One Ohana LLC, Peter Fukuchi, and each of their owners, directors, officers, employees, coaches, staff members, volunteers, contractors, agents, representatives, landlords, facility partners, sponsors, successors, and assigns (collectively, the “Released Parties”) arising from or related to participation in a One Ohana program, including claims based on a Released Party’s ordinary negligence.

This release does not apply to conduct that cannot lawfully be released, including gross negligence, reckless misconduct, or intentional misconduct.

3. Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from claims, liabilities, losses, or expenses arising from the participant’s conduct or violation of program rules. This paragraph does not require indemnification for conduct that cannot lawfully be indemnified.

4. Health, Fitness, and Medical Authorization

I certify that the participant is physically able to participate and that I have disclosed relevant medical conditions, allergies, limitations, and emergency information.

I authorize One Ohana staff to provide basic first aid and, when reasonably necessary, to obtain emergency medical evaluation, treatment, or transportation. I understand that One Ohana does not provide medical insurance and that I am responsible for resulting medical and transportation expenses.

I understand that a participant suspected of a concussion or other significant injury may be removed from activity and may be required to provide medical clearance before returning.

5. Rules and Conduct

The participant agrees to follow facility rules, safety instructions, and coach directions. One Ohana may remove a participant whose conduct is unsafe, disruptive, or inconsistent with program requirements.

6. Required Photo, Video, and Audio Consent

I authorize One Ohana and its designees to photograph, record, livestream, reproduce, edit, publish, and use the participant’s name, image, likeness, voice, and athletic performance in any lawful medium for program operations, livestreaming, education, promotion, advertising, social media, and archival purposes, without additional compensation.

I understand that published material may be publicly accessible and may be shared by others.

7. Electronic Signature and Record

I intend my electronic signature and acknowledgments to be legally binding. I consent to receive and sign this document electronically.

One Ohana may retain the signed record, including the waiver version, program, participant, signer names, date and time, account email, and related transaction information.

8. Governing Law and Severability

Washington law governs this agreement. If any provision is found unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
